WESTPORT CONSERVATION COMMISSION
PUBLIC HEARING
SEPTEMBER 21, 2011

Notice is hereby given of a meeting of the Westport Conservation Commission pursuant to the Connecticut Inland Wetlands and Watercourses Act, and the Regulations for the Protection and Preservation of Inland Wetlands and Watercourses of the Town of Westport (IWW Regulations) to be held on Wednesday, September 21, 2011 in ROOMS 201/201A at 7:00 p.m. of the Westport Town Hall, 110 Myrtle Avenue. The Commission shall meet to take such action under the purview of the Town’s IWW Regulations and the Waterway Protection Line Ordinance as the meeting may determine with regard to the following:

Work Session I: 7:00 pm, Rooms 201/201A. (The work session is not a public hearing. The public is invited to attend but may not speak.) The following applications will be “received” by the Conservation Commission subject to determination of completion. A public hearing will not be opened at this time for the following applications:

1. Receipt of Applications
a. 41 Crescent Road: Application #IWW-8890-11 by Land-Tech Consultants, Inc. on behalf of Roger Quick, Heritage Homes to retain the existing single-family dwelling and for the subdivision of the property into four new single-family building lots.
b. 9 Woodside Lane: Application #IWW/M-8896-11 by Jason Edwards, L.S of J. Edwards & Associates, LLC on behalf of Gregory Peterson to amend wetland boundary map A-10.
2. Report by Colin Kelly, Conservation Compliance Officer on the status of existing enforcement activity.
3. 22 Owenoke Park: Request by Hee–Jung Moon for release of bond monies for plantings and sediment and erosion controls held as a condition of Permit #WPL-8275-08.
4. 273 Saugatuck Ave,: Request by Diane Parrish for release of bond monies for plantings and sediment and erosion controls held as a condition of Permit #WPL-8594-10.
5. 4 Tanglewood Lane: Request by Pamela Davis for release of remaining bond monies held for plantings as a condition of Permit #IWW, WPL/E-8229-07.
6. Other Business

Public Hearing: 7:30 pm, Rooms 201/201A. The following applications will be “received” by the Conservation Commission subject to determination of completion. If applications are determined to be complete the Commission will proceed by opening the hearing. (At this time interested parties may be heard after being recognized by the Chairman. Written communication may be received for all applications until the public hearing is closed.) Applications and plans may be examined in the Conservation Department, Room 205, Westport Town Hall, 110 Myrtle Avenue, during regular business hours of 8:30 a.m. to 4:30 p.m., Monday through Friday, excluding holidays.

1. 5 Hedley Farms Road: Application #IWW/M-8892-11 by Michael J Horvath on behalf of Robert Zapfel to amend wetland boundary map #I-6.
2. 2 Lyndale Park: Application #IWW,WPL-8888-11 by Jeffrey N Gordon of Codespoti & Associates, P.C.on behalf of Elvira Kovshov to legalize the construction of a stonewall and to correct drainage and erosion deficiencies. Portions of the work are within the wetland, the upland review area and the WPLO area of an unnamed stream.
3. 157 Riverside Avenue: Application #WPL-8891-11 by Barr Associates, LLC on behalf of Robert Gerber for a new single-family residence, patio, a/c units, driveway and drainage. Portions of the work are within the WPLO area and the 25-year floodplain of the Saugatuck River.
4. 92 Harbor Road: Application #WPL-8858-11 by Keith B Neilson, PE of Docko, Inc. on behalf of William Cohen to remove the existing wood pier and construct a 20 (+/-) LF of 4’ wide fixed wood pile or post-supported timber pier with wood and grate deck, install a new 8’ by 12.5’ float with associated ramp and restraint pilings waterward of the high tide line. Work is entirely within the WPLO area, the 25-year and the 100-year floodplains of the Saugatuck River.
5. 25 Ford Road: Application #IWW,WPL-8880-11 by David Fioreck, PE, LEP of Loureiro Engineering Associates, Inc. on behalf of Thomas M. Sinchak, Esq., 25 Ford Road LLC for environmental remediation consisting of shallow excavation, placement of a flexible membrane liner, backfill and restoration to the existing contour lines. In selected, limited areas, there will only be excavation and backfilling. Portions of the work are within the upland review area setback, the WPLO area and 25-year floodplain of the Saugatuck River.
6. 11 Great Marsh Road: Application #WPL-8889-11 by Land-Tech Consultant, Inc. on behalf of David Korus for an excavation and fill permit. The site is wholly with the WPLO area and the 25-year floodplain of the Saugatuck River.

Work Session II: (The work session is not a public hearing. The public is invited to attend but may not speak.)
1. Approval of July 18, 2011 field trip minutes.
2. Approval of July 20, 2011 meeting minutes.
3. 57 Partrick Rd.: Request by Eugene Cedarbaum to eliminate Condition 18 of Resolution #IWW,WPL/E-8496-09 that required the driveway remain permeable with said restriction to be placed on the land records and a request to release the bond monies being held for plantings and sediment and erosion controls.
4. Other business.

The Commission may not open new business on the agenda after 11:00 p.m. at the discretion of the Chairman. This includes applications scheduled for public hearings. Items shall be continued or rescheduled to a later date as necessary.
