LEGAL NOTICE OF DECISION

Notice is hereby given that at a meeting held on September 6, 2012, the Westport Planning and Zoning Commission took the following action:

1. DENIED: 10 Bluff Point Road, Revised Resolution #09-092: Coastal Site Plan: Pursuant to a remand decision from the court on Sept. 28, 2011, the Commission has reversed its earlier resolution of April 15, 2010, and has now denied this coastal site plan application, finding that the structure erected by the applicant acts as a flood and erosion control structure which is not permitted under Conn. General Statutes.

2. GRANTED: 1655 Post Road East, Appl. #12-039 by Westport Housing Authority for property owned by Westport Housing Authority for a Special Permit and Site Plan approval for redevelopment of premises and additional 21 additional units in a MHPD zone, PID #H09150000 and PID #H09151000.

3. DENIED: Amendment #648, Appl. #12-012 by Lawrence P. Weisman for a text amendment to the zoning regulations to add a new definition, §5-2 (Definitions) “Age Restricted Senior Housing – Age Restricted Senior Housing shall consist of dwelling units wherein it is legally required that at least one owner/occupant of each unit shall be a “senior”, as that term is required in these Regulations. Provided, however, that multi-level residences which would otherwise meet this definition but are accessible only by interior and/or exterior stairs may provide that at least one owner/occupant shall be fifty-five (55) years of age or older.” To amend Sec 11-2.2 (Special Permit Uses), to add 11-2.2.14, Age Restricted Senior Housing.

The above items were granted/denied with conditions, which are on file with the Planning and Zoning Office in Town Hall at 110 Myrtle Avenue.

Dated at Westport, Connecticut this 14th day of September, 2012
Catherine Walsh, Chairman, Planning and Zoning Commission
