LEGAL NOTICE OF DECISION
Notice is hereby given that at a meeting held on March 15, 2012, the Westport Planning and Zoning Commission took the following action:
1. GRANTED: 70 North Avenue, Appl. #12-002 by Westport Public Schools for property owned by the Town of Westport, for a Special Permit and Site Plan approval for the installation of permanent athletic field lighting in a Res AAA zone, PID #F12077000.
2. GRANTED: 70 North Avenue, Appl. #12-007 by Westport Public Schools for property owned by the Town of Westport for a Special Permit and Site Plan approval for installation of a permanent storage shed and scorer’s area on roof, in a Res AAA zone, PID # F1207700.
3. APPROVED: 100 Post Road East, Appl. #12-005 by Barr Associates, LLC for property owned by Old Westport Town Hall LLC, for a CAM Site Plan approval for a new retail building, in a BCD zone, PID #C09148000.
4. ADOPTED: Amendment #642, Appl. #11-053 by Barr Associates, LLC for an amendment to the Westport Zoning Regulations to modify Section 32-12, (Inclusionary Two-Family and Multi-Family Dwellings), to add the word “residential”; Section 32-12.7.2, (Floor Area Ratio) (FAR), to add “and BCD/H, to add “s” to zone; Section 32-12.7.2.2, to delete 40% and to add 30%, to add the words “exclusive of the affordable housing units, in the GBD, RBD, BCD, BCD/H & DDD #2 zones. The RPOD, RORD & BPD zones, with their smaller building standards, shall have no minimum non-residential (commercial) requirement.”; Section 32-12.11 (Parking) to replace the word “considered” with the word “allowed”; Section 32-12.15, (Affordability Requirement and Plan), Section 32-12.15.1, to add the word “residential”; To modify Section 32-12.16, (Traffic Analysis), to add the words “unless waived at the discretion of the Planning & Zoning Commission”; to modify Section 39A, (Inclusionary Housing Overlay District (IHZ); Section 39A-1, (Purpose) to add the word “residential”; Section 39A-10.3.2, (Floor Area Ratio FAR), to delete 40% and to add 30%, to add the words “exclusive of the affordable housing units, in the GBD, RBD, BCD, BCD/H and DDD #2 zones. The RPOD, RORD and BPD zones, with their smaller building standards, shall have no minimum non-residential (commercial) requirement; Section 39A-14 (Parking) to replace the word “considered” with the word “allowed”; and to modify Section 39A-19 (Traffic Analysis) to add the words to add the words “unless waived at the discretion of the Planning & Zoning Commission.” Effective date: 4/16/12
The above items were approved/granted with conditions, which are on file with the Planning and Zoning Office in Town Hall at 110 Myrtle Avenue.
