 LEGAL NOTICE OF DECISION 

Notice is hereby given that at a meeting held on April 3, 2023, the Westport Planning and Zoning Commission took the following action:  

1. GRANTED: 1 Burr Road: Special Permit/Site Plan Appl. #PZ-23-00018 submitted by 1 BURR ROAD LLC, property owner, to convert the existing 120-bed skilled nursing facility into a 68-bed memory care facility, for property located in Restricted Office Retail District #1, PID# C09089000. 

2. GRANTED: 49 Colony Road: Special Permit/Site Plan Appl. #PZ-23-00058 submitted by Curt Lowenstein of LANDTECH, for property owned by John Dahl and Amy Lundy, to retain and permit non-exempt grading to correct non-compliant steep slopes, for property located in the Residence AA district, PID# F11007000. 

3. GRANTED: 41 Charcoal Hill Road: Special Permit/Site Plan Appl. #PZ-23-00099 submitted by Brian Nesteriak of B&B Engineering, for property owned by Ben and Angela Gibson, to permit additional fill outside of the excavation and fill exemption limit, for property located in the Residence AAA district, PID# E16045000. 
4. GRANTED: 41 Wright Street: Special Permit/Site Plan Appl. #PZ-23-00051 submitted by Caroline Church De Lasa, for property owned by Frank Zmuda, to authorize non-exempt excavation and fill activities, for property located in the Residence AA district, PID# C09043000.
