LEGAL NOTICE OF DECISION
Notice is hereby given that at a hearing held on January 3, 2019, the Westport Planning and Zoning Commission took the following action:
- APPROVED: 25 Oak Ridge Park, Appl. #18-077 by Mel Barr, Barr Associates, LLC for property owned by Debra A. Kowalsky for a CAM Site Plan approval to install approximately 180 linear feet of pre-cast block bulkhead, for property located in a Residence A zone, PID #C07033000.
- GRANTED: 308 Greens Farms Road, Appl.#18-085 by Robert Pryor/LANDTECH for property owned by Jeffrey Swearinger and Getely Ross for a Special Permit and Site Plan approval for excavation and fill, for property located in a Residence AAA zone, PID #H07073000.
- ADOPTED IN PART/DENIED IN PART: Amendment # 754, Appl. #18-056 by Lawrence Weisman for the Coalition for Westport for a text amendment to the Westport Zoning Regulations and Subdivision Regulations is Denied in Part and Adopted in Part. The following changes were Adopted: §44-1.2, (Application requirements for Site Plans and Special Permits) to expand existing Certificate of Mailing requirements to include the Planning and Zoning Department as a recipient; §46-4 (Zoning Board of Appeals Procedures) to add standards for Notice Requirements consistent with what appears on the application checklist. The following changes were Denied: Changes to §44-1.2, §46-4, and §52-4.7, to add new requirement to post a sign on all properties which are the subject of a zoning application. Effective Date: February 3, 2019 . A copy of the adopted amendment is on file in the Westport Town Clerk’s Office and is on file in the Westport Planning and Zoning Office.
- DENIED: Text Amendment #756, Application #18-064 by Concettina Belta Caruso, Executor of the Estate of James S. Belta c/o Alan R. Spirer, Esq. for an amendment to the Westport Zoning Regulations to modify §11 (Residence AAA District) to add §11-14 to permit Agricultural Subdivisions as an allowed use and to create a new section, §56A (Agricultural Subdivision) to the Subdivision Regulations with eligible parcels to be located in the Res AAA district and at least twenty (20) acres in size and allowing eligible parcels to be 1) Subdivided with lot size requirements reduced from the 2-acre to 1-acre; 2) Contain an agricultural parcel that is at least twenty-five percent of the total lot size; 3) Allow development of the agricultural parcel with a single-family residence and a barn not to exceed 2,500 SF, and other outbuildings necessary to operate a farm; 4) Allow operation of a commercial farm stand on a seasonal basis; and 5) Require agricultural land in lieu of open space for purposes of applying Section 54-21 of the Subdivision Regulations.
