II PUBLIC HEARING              
At this time interested persons may be heard after being recognized by the chairman. 
Written communications may be received for all applications until the public hearing is closed.  Applications and plans may be seen and examined in the Planning and Zoning Office, Room 203, Town Hall, 110 Myrtle Avenue, Monday, Wednesday and Friday, 8:30 am to 3:00 pm Tuesday and Thursday 8:30 am to 4:30 pm.)
The Commission will not start a public hearing on any applications after 10:00 p.m.  The Commission will adjourn no later than 11:00 p.m.


1. 44 Reichert Circle:  (The following application has been withdrawn by the applicant) Appl. #17-030 by Konstantin Bandura for property owned by Konstantin Bandura for a Special Permit and Site Plan approval for excavation and fill for property located in a Residence A zone, PID #D12104000.


2. Amendment #736:  (The following application was opened and continued from 5/18/17, 6/1/17 and will be further continued to 7/6/17.  No testimony was previously taken and no testimony will be taken at this hearing) Appl. #17-027 by Peter Romano/LANDTECH, for an amendment to the zoning regulations to modify §5, (Definitions) and §34-5, (Parking Table) to allow Chiropractors to be regulated as Healthcare Professionals instead of Medical.


3. 25 Sturges Commons:  (The following application was opened and continued from 3/16/17, 4/6/17 and 5/4/17. No testimony was taken) Appl. #17-009 by John Minervini for property owned by Elizabeth Ehrlich and John Minervini for a Special Permit and Site Plan approval for Excavation and Fill, for property located in a Residence AA zone, PID #G12066000. Applicant’s presentation time:  5 minutes

4. 15 Spriteview Avenue:  (The following application was opened and continued to 6/15/17.  No testimony was taken) Appl. #17-028 by Andy Soumelidis/LANDTTECH for property owned by Oliver Wilson for a CAM Site Plan approval for a new single family dwelling, for property located in a Residence A zone, PID #B02174000.  Applicant’s presentation time:  15 minutes


5. 27 Soundview Avenue:  (The following was opened and continued to 6/15/17.  No testimony was taken)  Appl. #17-029 by Peter Cadoux Architects for property owned by 27 Soundview LLC for a CAM Site Plan approval for a new single family dwelling, for property located in a Residence A zone, PID #D03093000.  Applicant’s presentation time:  15 minutes

6. 124 Hillandale Road:  Appl. #17-031 by R.I Pools, Inc. for property owned by Jeremy and Susan Ford for a Special Permit and Site Plan approval for excavation and fill for property located in a Residence AAA zone, PID #G08086000.  Applicant’s presentation time:  10 minutes


7. Amendment #733:  (The following application was opened and continued to 6/15/17.  No testimony was taken) Appl. #17-024 by Mel Barr, Barr Associates, LLC for an amendment to the zoning regulations to modify §22 (Restricted Office-Retail Districts #1, 2, & 3) to allow Electric Automotive Establishments (or Service Centers) in the RORD #2 zone as an “adaptive reuse” based on building and site criteria.  


8. Amendment #737:  Appl. #17-034 by the Westport Planning and Zoning Commission for modifications to standards associated with §36, Village District Overlay (VDO) Zone/Westport Center.  Modifications are proposed to the underlying zoning district standards relating to the Front Lot Line requirements as follows:  Modifying Sec. 21-4.1 to restore the thirty-foot (30’) front-setback requirement in the Restricted Professional Office District; modifying Sec. 22-4.3.1 to restore the thirty foot (30’) front-setback requirement in the Restricted Office Retail District; and modifying Sec. 23-4.1 to restore the thirty foot (30’) front-setback requirement in the Restricted Business District. Modifications are also proposed to §36-2.3, Design Standards (in the VDO) to correct an error in a cross-reference. Modifications are additionally proposed to §43-5.2 to restore language allowing small scale projects located in the VDO, to be eligible for Site Plan Waiver from the Planning and Zoning Director by deleting language requiring review by the Planning and Zoning Commission. New language is added to §43-5.2 to clarify design review may be required by the Historic District Commission and/or Joint Committee prior to the granting of a Site Plan Waiver by the Planning and Zoning Director.
