LEGAL NOTICE AND AGENDA
WESTPORT CONSERVATION COMMISSION
PUBLIC HEARING
NOVEMBER 16, 2011

Notice is hereby given of a meeting of the Westport Conservation Commission pursuant to the Connecticut Inland Wetlands and Watercourses Act, and the Regulations for the Protection and Preservation of Inland Wetlands and Watercourses of the Town of Westport (IWW Regulations) to be held on Wednesday, November 16, 2011 in the auditorium at 7:00 p.m. of the Westport Town Hall, 110 Myrtle Avenue. The Commission shall meet to take such action under the purview of the Town’s IWW Regulations and the Waterway Protection Line Ordinance as the meeting may determine with regard to the following:

Work Session I: Auditorium, 7:00 p.m. (The work session is not a public hearing. The public is invited to attend but may not speak.) The following applications will be “received” by the Conservation Commission subject to determination of completion. A public hearing will not be opened at this time for the following applications:

1. Receipt of Applications
2. Report by Colin Kelly, Conservation Compliance Officer on the status of existing enforcement activity.
3. Continued discussion with soil scientist, Thomas Pietras of Soil Science and Environmental Services to consider possible changes to policies to wetland boundary determinations involving site plan and subdivision applications.

Public Hearing: Auditorium. 7:45 p.m. The following applications will be “received” by the Conservation Commission subject to determination of completion. If applications are determined to be complete the Commission will proceed by opening the hearing. (At this time interested parties may be heard after being recognized by the Chairman. Written communication may be received for all applications until the public hearing is closed.) Applications and plans may be examined in the Conservation Department, Room 205, Westport Town Hall, 110 Myrtle Avenue, during regular business hours of 8:30 a.m. to 4:30 p.m., Monday through Friday, excluding holidays.

1. 11 Great Marsh Road: Application #WPL-8937-11 by Land-Tech Consultants, Inc. on behalf of David Korus for an excavation and fill permit. The site is wholly within the WPLO area and the 25-year floodplain of the Saugatuck River.

2. 14 Canal Road: Application #WPL-8922-11 by Land-Tech Consultants, Inc. on behalf of John & Cynthia Fitzgerald to raze the existing residence, construct a new single family dwelling, connect to the municipal sanitary sewer, and associated site improvements. Work is within the WPLO area, 25-year and 100-year floodplains of the Saugatuck River.

Work Session II: (The work session is not a public hearing. The public is invited to attend but may not speak.)

1. Approval of October 6, 2011 Show Cause Hearing minutes.
2. Approval of October 19, 2011 meeting minutes
3. Approval of October 31, 2011 Show Cause Hearing minutes.
4. 3 Great Marsh Road: Request by James Jamieson, AIA on behalf of Bryan Birch for modification of Permit #WPL-8616-10 to reduce new house footprint, relocate pool and shed and overall impervious footprint.

5. 22 Evergreen Avenue: Request by Craig Smith of Complete Home on behalf of Robert and Marian Precious to issue an Administrative Approval for installation of a 112 ft length of fence located partially along the northern property line adjoining the property at 24 Evergreen Avenue and within the 25 ft upland review area and 32 ft of fencing on the northeastern edge of the driveway within the wetland.

6. 21 Grove Point Road: Request by Ann Lathrop on behalf of Elizabeth Daines to modify Permit #IWW,WPL-8769-11 by enlarging the foundation footprint by 2 ft. on the south side of the previously approved addition.

7. 123 Compo Road South: Request by staff to issue an Administrative Approval for construction of a screened porch partially over an existing flagstone patio and within the 50 ft upland review area.

8. Other Business

The Commission may not open new business on the agenda after 11:00 p.m. at the discretion of the Chairman. This includes applications scheduled for public hearings. Items shall be continued or rescheduled to a later date as necessary.
